The Information Commissioner’s Office (ICO) and Competitions and Marketing Authority (CMA) have issued a joint call against design practices that could undermine website users’ control over their personal information and restrict their choices.
These practices include language or presentation that push the user towards a decision (e.g. on privacy policies, cookie consent banners, and direct marketing sign-ups).
The ICO has stated that it considers it to be “an infringement of data protection law where design practices steer people to decisions that do not reflect their privacy preferences, whilst making it harder for them to choose more privacy-friendly options.”
It will take formal action where necessary to protect consumers, especially vulnerable consumers.
